In order to further standardize the housing rental market, stabilize the housing rental, promote the healthy development of the housing rental market, safeguard the legitimate rights and interests of the parties involved in housing rental, and accelerate the formation of a multi-level housing supply and consumption system, with the consent of the municipal government, the housing rental market is further regulated in accordance with the Measures for the Administration of Commercial Housing Leasing (Order No.6 of the Ministry of Housing and Urban-Rural Development), Several Provisions on the Administration of Housing Leasing in Beijing (Order No.194 and Order No.231 of the Municipal Government) and other relevant regulations.
First, attach great importance to standardizing the housing rental market and stabilizing housing rents.
Standardizing the housing rental market and stabilizing the housing rent are the specific requirements for implementing the macro-control policy of the real estate market, which is closely related to the interests of the people and is of great significance to promoting the goal of living and living. Relevant municipal departments and district and county governments should attach great importance to it, comprehensively use economic and legal means, actively explore and innovate, promote the supply of rental housing through multiple channels, strengthen the service and management of the housing rental market, and effectively stabilize the housing rental relationship and rental price.
Two, encourage and revitalize idle housing into the housing rental market.
District and county governments should organize township governments, sub-district offices, and grassroots organizations such as residents’ committees and villagers’ committees to actively guide all kinds of idle houses in their jurisdictions for rent; All units can invest and transform existing idle houses into low-rent youth apartments for lease operation on the premise of meeting the requirements of relevant laws and regulations such as planning, construction, fire protection, public security and sanitation, and encourage social investment institutions to participate in investment and operation.
Third, strengthen the construction of rental housing
The stock of residential construction land in the central city of this city should be mainly used for the construction of rental housing. In areas where the demand for rental housing is concentrated along the subway and around schools, planning and construction of rental housing can be encouraged as appropriate; Encourage industrial parks to focus on the construction of rental housing by using residential land in accordance with the land use planning of the park, and rent it to employees in the park.
Fourth, accelerate the development of public rental housing
Strengthen government construction and acquisition, implement various support policies, encourage social units to build public rental housing by using existing construction land, encourage investment institutions and real estate development enterprises to build, hold and operate public rental housing, and increase the supply of effective housing. The single set of public rental housing has a construction area of 40 square meters, which mainly meets the basic housing needs.
Five, actively implement the preferential tax policies for rental housing.
Rental housing meets the requirements of public rental housing in the Notice of the Ministry of Finance and State Taxation Administration of The People’s Republic of China on Supporting Preferential Tax Policies for the Construction and Operation of Public Rental Housing (Caishui [2010] No.88). After being recognized by the departments of housing and urban construction and taxation, it can enjoy various tax benefits stipulated by the state during the construction and operation of public rental housing.
Six, strengthen the management of real estate brokerage institutions for the record.
Real estate brokerage institutions and branches shall, within 30 days from the date of issuance of business licenses, go to the housing and urban-rural construction departments of the districts and counties where they are located for the record. The municipal housing and urban-rural construction department will regularly send a copy of the list of unregistered real estate brokerage agencies to the municipal administrative department for industry and commerce, which will urge them to go through the filing procedures as soon as possible when handling the annual inspection of industry and commerce.
Seven, explore a new model of housing rental business.
Encourage relevant municipal departments, district and county governments to set up state-owned housing leasing institutions, accept the entrustment of housing owners or other rights holders as stipulated by laws and regulations, focus on housing leasing operations, and provide daily maintenance services to the houses entrusted for leasing operations. Support collective economic organizations to set up or entrust housing leasing institutions, raise surplus housing of the collective economic organizations to carry out centralized leasing management, uniformly release leasing information, carry out housing management, handle contract filing, pay taxes and other relevant procedures, and give priority to the collective surplus labor force to engage in rental housing management. The municipal housing and urban-rural construction department shall, jointly with the municipal legal, industrial and commercial, public security and other departments, accelerate the research and formulation of specific measures for the management of housing leasing in this Municipality in accordance with the relevant provisions of the Several Provisions on the Administration of Housing Leasing in Beijing (DecreeNo. 194th of the municipal government and DecreeNo. 231st of the municipal government).
Eight, promote the establishment of a stable housing lease relationship.
The lessor and lessee shall sign a house lease contract according to law. During the lease period, the lessor shall not shorten the lease period or increase the rent without the consent of the lessee; After the expiration of the lease term, if the lessor continues to lease the house, the original lessee shall have the priority to lease it under the same conditions.
Nine, the full implementation of the provisions of the housing lease registration.
If the leased house is used for living, the lessor shall, within 7 days from the date of concluding the house lease contract with the lessee, go through the house rental registration formalities at the grass-roots management service station where the house is located. Where a real estate brokerage agency makes a transaction through intermediary or agency, it shall inform the leasing parties in writing to handle the registration procedures for house rental, and fill in relevant information through the online filing system for house rental contracts. If the real estate brokerage agency fails to fill in the housing rental filing information as required, and the lessor fails to handle the housing rental registration, change and cancellation procedures as required, the housing and urban construction, public security and other departments shall investigate and deal with it according to law.
Ten, strengthen the territorial management of housing rental.
The district and county governments should bring the housing lease management into the scope of comprehensive community management; Township governments and sub-district offices shall coordinate and handle housing lease related affairs and disputes within their respective jurisdictions; Residents’ committees and villagers’ committees shall assist in the management of house leasing, and urge the leasing parties to abide by the relevant provisions of the state and this Municipality on the management of house leasing; Grass-roots management service stations shall, in accordance with the provisions, do a good job in various services such as publicity of relevant policies and regulations and housing use safety knowledge, registration of rental housing, establish a patrol system, and strengthen daily inspection of housing rental.
Eleven, strengthen the dynamic monitoring of the housing rental market.
Housing and urban construction, development and reform, statistics and other departments should strengthen the monitoring of housing rental prices, timely release relevant information on the housing rental market, and guide both parties to reasonably determine the housing rental price.
Twelve, strengthen the comprehensive law enforcement inspection
Housing and urban construction, development and reform, human resources and social security, industry and commerce, public security, urban management and other departments should strengthen law enforcement linkage, regularly carry out special rectification of real estate brokerage institutions and housing rental market, and severely investigate and deal with real estate brokerage institutions and personnel who violate the relevant provisions of the state and this Municipality on housing rental management.
