A research report of Xicheng District Procuratorate in Beijing pointed out that in the corruption and bribery cases handled by the hospital in the past two years, retired (divorced) cadres have become "professional brokers" who commit bribery crimes, which is more popular than others. Recently, the reporter of the procuratorate daily "Integrity Weekly" investigated and sorted out this phenomenon.
Residual heat of power: keeping corruption "temperature"
The reporter found that in the "Tiger Fighting" campaign in 2013, many retired "old tigers" such as Chen Baihuai, Guo Yongxiang and Ni Fake were found out, which is another feature of the new round of anti-corruption.
When Chen Baihuai, 63, was arrested, he had retired as the vice chairman of Hubei Provincial Political Consultative Conference for nearly a year. However, due to his good disguise, cautious behavior and careful consideration, the problem of corruption was not exposed during his tenure, even when he led improperly, or even when he retired. Therefore, Chen Baihuai still maintains its energy in local politics. When he retired without leadership, he thought he had landed safely and everything was all right.
Guo Yongxiang, 64, had already stepped down as the deputy director of the Standing Committee of the Sichuan Provincial People’s Congress and became the chairman of the Provincial Federation of Literary and Art Circles. In addition to the corruption of these "old tigers", many "old flies" have become the main force of corruption after 60 years old. Wu Zhiqiang, deputy secretary of Foshan Municipal Committee, former secretary of the Political and Legal Committee and former vice chairman of the CPPCC, retired early from the position of vice chairman of Foshan CPPCC in 2011. However, a few months later, he was accused by the procuratorate of taking advantage of his position to accept Luo Zuohong’s cash of 5.4 million yuan in 10 times from July 2007 to August 2011. It is worth noting that after Wu Zhiqiang retired in 2011, Luo Zuohong also gave him RMB 1 million in cash twice, of which 938,000 yuan was used by Wu Zhiqiang to entrust his brother to help him buy a Volkswagen Touareg off-road vehicle.
Yin Guoyuan, the former deputy director of Shanghai Housing and Land Resources Administration, who was called "making profits for people while in office, and rolling in financial resources after retirement", can be said to be an early model of exerting his "power waste heat" to the fullest. Yin Guoyuan became the deputy director of Shanghai Real Estate Bureau in January 1995. Because of the power of land examination and approval, Yin Guoyuan accumulated a high popularity in land examination and approval and house demolition during his reign, in addition to gaining benefits for himself. After retiring in 2005, Yin Guoyuan was elected as the president of the Shanghai Land Society. He used his accumulated resources and personal connections to help real estate developers to "thread the needle" and "help" these developers with their land problems, and used the deep network established during his tenure to openly ask for and accept bribes. In 2005 alone, Yin Guoyuan asked Jiang Moumou, a real estate developer, for bribes of more than 28 million yuan, more than the money he received when he was in office.
Some experts say that the "power waste heat" in recent years is a new corruption channel caused by the lack of supervision of public power, which has strong secrecy. It is mainly manifested in that when some officials are in office, they use the influence of power to seek illegal interests for some enterprises and individuals legally and illegally, reasonably and unreasonably. In order to "protect" themselves and avoid the supervision and investigation by the discipline inspection and supervision departments, they do not seek immediate direct returns, but lay the foundation for future retirement, resignation or going to sea for greater benefits.
Experts suggest that it is necessary to increase the supervision and assessment of retired (divorced) officials. In addition, the discipline inspection departments at the next higher level should regularly visit retired (divorced) leading cadres who stay in their posts to understand their daily activities and ideological trends, and promptly remind or stop them if they find abnormal signs. Institutional arrangements for the whereabouts of retired (divorced) leading cadres will not only enable retired (divorced) leading cadres to exert their residual heat and continue to serve the society, but also help prevent power options.
Interest-driven: violation of law and discipline "walking the hole" is busy
"Going to the cave" is a new term that appeared in the entertainment industry in the 1980s. It refers to an actor who goes out to perform privately for extra money. The greater his fame, the higher his appearance fee. In recent years, some government officials or former officials have also appeared the phenomenon of "going to the cave". They take advantage of "hidden rules" to collect high "appearance fees" or "red envelopes" by attending business activities such as new product launches, celebrations, ribbon cutting, unveiling and launching. Many officials have slipped into the abyss of corruption in this self-considered "reasonable" income.
On February 15th, 2014, an authoritative media exposed a fake organization named "China Hospital Management Association", which illegally held the "2013 China Hospital Management Academic Annual Conference and Award Ceremony" in a five-star hotel in Beijing. The awards presented here were all clearly priced, and the organizers issued more than 300 medals, with a profit of more than 10 million yuan. Remarkably, in the "Conference Guide" issued by the "Gui Li" Society, the honorary leaders of the Society are all former leaders who have held leadership positions in relevant departments, that is, the so-called retired leaders. The person in charge of the organizer said: "Please ask (former) leaders for a fee. Which (former) leader is present, and then give people some money. " These (former) leaders have become accomplices of this illegal society. The media commented that for the winners, spending money can not only buy the reputation of a national name, but also attract these heavyweights who are present at the scene. It is an honor for them to stand with these former leaders of the industry and take a group photo. Are these heavyweight guests familiar with the operation of the appraisal, and what possible interest relationship exists behind it?
Huang Jingping, a professor at the Law School of Renmin University of China, told the reporter that the main reasons why "post-60 s" cadres are driven by interests into accomplices in illegal activities are as follows: First, professional exchange relationships in the name of academic research have obtained unreasonably high manuscript fees; Second, it was not carefully identified and was cheated by people with ulterior motives; The third is to seek illegitimate interests, knowing that it is an illegal organization, but driven by interests, subjectively completing a "walking hole" activity. It is a good thing for individuals to retreat, but if power retreats, it will easily lead to corruption. Therefore, Huang Jingping suggested that the relevant organizations and personnel departments should, in accordance with the provisions of the cadre management system, give stricter management to retired (divorced) leading cadres and introduce some specific behavioral requirements, so as to standardize their behavior of taking honorary leadership positions in illegal activities, and so as to use the system to stop the phenomenon of "walking holes" of retired (divorced) leading cadres.
Wang Yukai, a professor at the National School of Administration, believes that our public servants, including leading cadres, can’t engage in profit-making activities in the field he was in charge of for three years after retirement, which is very clear in the Civil Service Law. It is ok for former leaders of some units and departments to participate in some non-profit social welfare undertakings. However, if they take part in profit-making activities within three years of retirement, it is not allowed and it is against the policy.
Power Re-employment: A New Variety of Corruption Virus
With the increasing anti-corruption efforts and the increasingly narrow trading space of power and money, "shadow corruption", as a new variant of corruption virus, has gradually become a "hidden rule" between officials and bribers. Because the relevant departments ignore the phenomenon of re-employment of officials after retirement, more corrupt officials choose to "make an appointment to take bribes" and enjoy this special feast of "shadow corruption" unscrupulously after leaving their jobs and retirement.
Li Yuan, former vice minister of the Ministry of Land and Resources, retired as early as 2008. After Li Yuan retired, he held several posts and had frequent social activities. Eventually, due to his violation of discipline, he "lost his integrity". Liu Yunzhou, a colleague of Li Yuan’s Ministry of Land and Resources and the former president of China Land and Resources Newspaper, who has also retired, was also detained for violating the law and discipline.
Wang Yachen was a well-known reformer in the 1980s. He was the winner of the National May 1st Labor Medal and many other honors and auras. In 1986, he became the deputy secretary and mayor of Fuxin Municipal Committee of Liaoning Province, and later he was appointed as the secretary of the Municipal Party Committee and director of the Municipal People’s Congress. He served as the "top leader" of the party and government in Fuxin City for more than ten years. These experiences laid the groundwork for Wang Yachen’s "shadow corruption" after retirement. In February 2002, Wang Yachen, who had retired for many years, was hired as a consultant of Fuxin Shuanglong Real Estate Company and soon became the chief financial officer. Later, Wang Yachen served as the commander-in-chief of the construction of Fuxin Trade City, and all things were represented by Wang Yachen. In the meantime, he often tells the work of the municipal party Committee and the municipal government, and sometimes even threatens the organization, which is unreasonable. Wang Yachen is very familiar with Fuxin from top to bottom, and his influence is deeply rooted. As long as he comes forward, especially in the units where he promoted and reused a group of leading cadres, everything is a green light.
According to media reports, many retired leading cadres in Shanghang County, Fujian Province hold various idle posts of local Zijin Mining Group, and they receive annual salaries ranging from 100,000 yuan to several hundred thousand yuan. In addition, Zijin Mining Group also has former leading cadres from Beijing and the province. For example, Chen Mou, former chief engineer of the former Ministry of Geology and Mineral Resources and president of the Chinese Academy of Geological Sciences, who is an independent director of the company; Lin, former director of Fujian Assets Appraisal Center, director of Fujian State-owned Assets Administration Bureau and deputy director of Fujian Provincial Department of Finance, served as the independent director of the company. At the same time, some leading cadres also own shares in Zijin Mining through various channels.
Professor Huang Jingping pointed out that at present, the phenomenon of "shadow corruption" of retired leading cadres is more common. Some leading cadres like to promote their confidants in order to go into business after retirement, and they can get the care of these old subordinates in administrative examination and approval, project establishment, enterprise production and management, and get greater benefits.
A number of interviewed experts suggested strengthening the accountability for oversight of personnel, putting relevant "no" and "no" into practice, minimizing the discretionary space of "top leaders" and preventing leading cadres from "raiding" wholesale official hats to implement "shadow corruption". Secondly, experts pointed out that in addition to strengthening the power supervision of on-the-job leading cadres, it is also necessary to standardize the behavior of leading cadres leaving their jobs.
Tightening the institutional cage: removing the luck of corruption
The reporter found from the investigated corruption cases of "post-60 s" that many on-the-job officials had to do some "stupid things" that backfired because of the feelings of "old leaders" and "old bosses". Many times, it is the "shadow" of retired (retired) officials after the age of 60, especially retired (retired) senior officials, that influences and promotes the incumbent officials into the whirlpool of corruption, which leads to a series of vicious corruption problems of collusion between government and business. Therefore, some experts pointed out that in the past anti-corruption, there was leniency or even exemption for retired (divorced) "tigers" and retired (divorced) "flies". Once senior cadres "retire naked", it almost means "landing safely" and will no longer be investigated for party discipline and criminal responsibility. In order to standardize the part-time (post-holding) behavior of retired party and government leading cadres and prevent the corruption of retired party and government leading cadres, on October 30, 2013, with the approval of the Central Committee of the Communist Party of China, the Central Organization Department issued a notice and issued the Opinions on Further Regulating the Part-time (post-holding) of Party and government leading cadres in enterprises. If they do take part-time jobs (posts) in enterprises because of work needs, they should be strictly examined and approved in accordance with the cadre management authority. Within three years after resigning from public office or retiring (leaving), I will not get a part-time job (post) in an enterprise in the area and business scope under the jurisdiction of my original post, nor shall I engage in profit-making activities related to the business under the jurisdiction of my original post.
Huang Jingping believes that in addition to using the system to curb the corruption of leading cadres after the age of 60, the current Central Inspection Team should strengthen the inspection of retired (divorced) leading cadres. Purposefully understand the problems existing in the integrity of retired leading cadres in the inspected areas and units through various channels. During the inspection, it was found that retired (divorced) leading cadres were suspected of serious violations of discipline and law, and reported to the Central Inspection Leading Group in a timely manner.
